The main objective is to set up prisons as Reform Homes or Sudhaar Griha
The chief minister instructed officials to create a formal plan for an open jail in the state. “Our State Cabinet has recently given the green light to a new set of guidelines for our jails. This is a significant step towards improving our prison system. We should strive to transform our prisons into effective centers for rehabilitation. To achieve this goal, the establishment of an ‘Open Jail’ can be advantageous. At present, there is a semi-open jail functioning in Lucknow.”
New Prisons: Sudhaar Griha or Reform Homes
The Uttar Pradesh Chief Minister, Yogi Adityanath, has emphasized the need for various arrangements and measures to improve the prison system.
- These include conducting security assessments of prisoners, establishing a grievance redressal mechanism, establishing a Prison Development Board, promoting a positive change in behavior towards prisoners, and providing separate accommodation for women prisoners and transgender individuals.
- These initiatives aim to enhance security, address concerns and grievances, promote rehabilitation, and ensure the dignity and well-being of all prisoners, including vulnerable groups.
- By implementing these measures, the goal is to create a more efficient, fair, and humane prison system in Uttar Pradesh.
- Strict measures must be taken to ensure the safety and security of high-risk prisoners who pose a threat to the country and society, such as habitual criminals and terrorists. The highest standards should be enforced to guarantee their well-being.
- There should be severe penalties for the use of prohibited items like mobile phones within prisons.
Furthermore, the chief minister emphasized the importance of leveraging technology to enhance transparency in prison administration. Currently, the entry and exit of prisoners in state jails are being managed through e-prison, which is a commendable step towards incorporating technology in the system.
Current Prisons
- The existing laws governing prisoners in jails, namely the Jail Act of 1894 and the Prisoners Act of 1900, have been in place since before independence.
- However, many of their provisions do not align with the changing circumstances and lack a rehabilitative approach for prisoners.
- The Prison Act of 1894 aims to maintain discipline and control among inmates, but our focus should be on reform and rehabilitation. Therefore, it is essential to implement new acts that reflect the needs of the present and future.
The Government of India has recently developed the Model Prison Act 2023, which prioritizes the reformation and rehabilitation of prisoners. It serves as a valuable resource for us. Based on this Model Act, a new Prison Act specific to our state will be formulated.
